The short version
Our apps are licensed to you through the App Store under Apple’s standard terms. These terms cover this website and add a few things specific to our apps. Our apps are provided as they are. Backmarker is an unofficial app, and its race data can be late or wrong.
1. Who these terms are with
These terms are between you and Brian Fuller, an independent developer in Colorado, USA, who publishes apps as Rocky River Apps (“we”, “us”). By using this website or our apps, you agree to them. If you don’t agree, please don’t use them.
2. Our apps and the App Store
You get our apps from Apple’s App Store. Your license to use them is Apple’s Licensed Application End User License Agreement (the “Standard EULA”), at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These terms add to it and don’t replace it. If they conflict, the Standard EULA wins. Apple handles all purchases, refunds and payments.
3. Backmarker
- Unofficial. Backmarker is an unofficial app and is not associated in any way with the Formula One companies, any Formula 1 team or any Formula 1 driver. F1, FORMULA ONE, FORMULA 1, FIA FORMULA ONE WORLD CHAMPIONSHIP, GRAND PRIX and related marks are trade marks of Formula One Licensing B.V.
- Accuracy. Race data comes from third-party sources. It can be delayed, incomplete or wrong. Radio transcripts are generated automatically and may contain errors. Don’t rely on Backmarker for anything where an error would cost you, such as betting.
- Sources. Race data © Jolpica F1 and OpenF1, licensed under CC BY-NC-SA 4.0. Circuit geometry is derived via FastF1, and track outlines are © bacinger/f1-circuits, both MIT licensed. Weather is provided by Apple Weather. Team-radio audio streams from Formula 1’s servers and remains Formula 1’s.
4. Using our apps and this website
If you’re under 18, please use our apps and this website with a parent or guardian’s permission. Please don’t:
- copy, modify, redistribute or resell our apps;
- reverse engineer them, except where the law allows it;
- remove copyright or other notices;
- use them for anything unlawful, or in a way that could damage them or other people’s use of them.
5. What’s ours
Our apps, this website, our names and our logos belong to us and are protected by copyright and trademark law. Third-party names and marks belong to their owners.
6. Feedback
If you send us ideas or suggestions, we may use them without any obligation to you. Thank you for sending them.
7. Other sites
This website and our apps link to services we don’t run, such as the App Store, Formula 1 and the FIA. We aren’t responsible for their content or practices.
8. No warranty
Our apps and this website are provided “as is” and “as available,” without warranties of any kind, express or implied. These include warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that they will be uninterrupted or error-free.
9. Limits on liability
To the fullest extent the law allows, we aren’t liable for any indirect, incidental, special, consequential or punitive damages. Nor are we liable for lost profits, data or use arising from our apps or this website. Our total liability for any claim is limited to the amount you paid for the app concerned in the 12 months before the claim.
10. Changes
We may update these terms. When we do, we’ll change the date at the top. If you keep using our apps or this website after a change, you accept the new terms.
11. Law and disputes
These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-law rules. If a dispute comes up, please email us first; most problems can be fixed that way. Any dispute we can’t resolve will be handled in the state or federal courts located in Colorado, or in small claims court where it applies. Nothing in these terms takes away rights you have under the consumer protection laws where you live.
12. The rest
If any part of these terms can’t be enforced, the rest still applies. These terms, the Standard EULA and our privacy policy are the whole agreement between us about our apps and this website.
